Editorial Department: I would like to borrow some valuable information from your magazine to challenge some of the problems that Mr. Li Jiacheng's patent CN1699157A has. If there is anything wrong, please ask the readers to give corrections.
1. Prior patents Zhang Shuda, a modified engine oil, publication number: CN 1414074A, patent number: ZL 02131228.1, application date: 2002.97.17, publication date: 2003.4.30, authorization announcement date: 2005.9.14.
2. Post-patent application Li Jiacheng, ultra-dispersed nanosphere diamond emulsion and its preparation method, publication number CN 1699157A, application date: 2005.5.25, publication date: 2005.11.23.
3. The patents claimed by Li Jiacheng are suspected of infringement 3.1 CN1699157A Manual page 5/12, line 6: “Tianjin Qianyu Superhard Technology Co., Ltd. gasoline engine bench test results show that the use of the ultra-disperse 1~3 nanospheres of the present invention Diamond emulsion as a lubricant additive, can save fuel 5~10%, output power increased by 4%, cylinder pressure increased by 25%, idle speed increased by 10%, idle discharge: HC reduced by 50%; NOX decreased by 20%, engine oil used The time is extended by 2~4 times."
The above-mentioned related data is copied from a patent published by the infringed patentee Zhang Shuda at an international academic conference: “The Peculiar Efforts of Super-Disperse Diamonds in Lubricating Oils”, The 4th Zhengzhou International Superhard Materials and Products Conference proceedings. Beijing: Mechanical Industry Press. 2003, 181~185. This collection of papers was published in August 2003. The patentee Zhang Shuda made a speech at the international academic conference and attracted a lot of interest from the participants. He discussed with experts from various countries for more than an hour. The summary in the previous paper reads: "Use it to save about 5% to 10% of fuel, increase output power by about 4%, increase cylinder pressure by about 1/4, increase idle speed by ~10%, reduce idle HC and NOX, respectively. 1/2 and 1/5... engine oil usage can be extended by 1 to 4 times." The test procedure and specific measurement data are described in detail. According to the conference address book, you personally attended the international academic conference. On April 30, 2003, the National Intellectual Property Office of the People's Republic of China published Volume 19, No. 18 (Total 894), page 119, which published a summary of the invention patent, which lists these data. Li Jiacheng’s patent was only applied on May 25, 2005. How do you use the 2005 invention when you applied for the patent on September 17, 2002, and the paper published on April 30, 2003 and published in August 2003? Do we really enter the time tunnel?
3.2 The claim of CN1699157A is on page 1/3 item 1: Super-dispersed nanosphere diamond emulsion, which is characterized by adding 0.1-1.0 g of nano-scale diamond to 1000 ml of base emulsion, which is 0.01%-0.1 %Vol. The specification of CN 1699157A is inverted on line 4/12: in the super-dispersed nanosphere diamond emulsion and lubricating oil at a ratio of 1:16~20... The above two paragraphs can be combined to calculate the nanometer of CN 1699157A patent. The actual concentration of diamond in the oil is 5 x 10-6 to 6.25 x 10-5 Vol.
This is an obvious infringement of the patent ZL 02131228.1. Its concentration range is completely covered by the prior patent ZL 02131228.1. It has no creation, novelty, and does not meet the "three characteristics" of the patent law. ZL 02131228.1 Description of the patent specification: "Super-dispersed carbon particles ... added concentration of 1 × 10 -7 ~ 9 × 10-5 Vol, of which diamond accounts for 10% ~ 98%." According to this calculation, nano-diamond in oil The concentration range is 1×10-8~8.82×10-5Vol.
4. Warm Tips Dear Mr. Li Jiacheng: Your above practices have brought many adverse effects to our company and to me personally. The letter was written in early 2006 but has never been made public. I hope that you can be far-sighted and mitigate these undesired consequences in an appropriate manner.
